Expedited continued-stay appeal template

An urgent appeal for concurrent-review denials while the patient is still in treatment: certification of urgency, current clinical facts and a request for continued coverage.

By the ClaimParrot editorial team · Who we are · Reviewed · 5 min read · 6 cited sources

Quick answer

Use this letter when a plan stops authorizing days while the patient is still in inpatient psychiatric, residential, PHP or withdrawal-management care. It asks for an expedited decision, generally due within 72 hours, backed by the treating clinician's statement of urgency, cites current clinical facts, and asks the plan to confirm coverage while the appeal is pending where the rules require it. When does a continued-stay denial qualify for an expedited appeal?

When applying the standard timeframe could seriously jeopardize the patient's life, health or ability to regain maximum function. Under the ERISA claims rules, a plan must treat a claim as urgent when a physician with knowledge of the condition says it is. Medicaid managed care rules use a similar test that names mental health explicitly.

  • Fits: inpatient psychiatric, residential, PHP or withdrawal-management days ending at concurrent review while the patient is still admitted.
  • Fits: an approval for fewer days than the attending clinician requested, where discharge on the approved date is not yet safe.
  • Does not fit: the patient has already been discharged. Use the residential or PHP letter as a standard appeal.
  • Check first: for Medicare and Medicare Advantage inpatient hospital stays, the discharge notice gives a separate fast appeal to the Quality Improvement Organization.
02

How fast must the plan decide an expedited appeal?

Generally within 72 hours of receiving the request for employer plans, ACA-regulated plans, Medicaid managed care plans and Medicare Advantage plans. ERISA also has a faster rule for urgent requests to extend an ongoing course of treatment made at least 24 hours before it ends: the plan must decide within 24 hours.

Expedited timing and continued coverage by plan type (verified October 14, 2026)
Plan typeExpedited appeal decisionCoverage while the appeal is pending
Employer plan under ERISA72 hours; urgent extension requests made 24+ hours before the end of treatment are decided within 24 hoursA reduction or end of an ongoing course of treatment is itself appealable, and the plan must allow time to appeal and decide before it takes effect
Non-grandfathered group or individual plan (ACA rules)72 hoursThe ACA rules require continued coverage of an ongoing course of treatment pending the outcome of an internal appeal
Medicaid managed care72 hours (extendable by up to 14 days in limited cases)Benefits can continue if the enrollee, not the provider, asks within 10 calendar days of the notice or by the effective date, whichever is later
Medicare Advantage72 hours for expedited reconsiderationsInpatient hospital discharges follow the Medicare discharge notice and Quality Improvement Organization review

These are federal rules; the notice, the plan documents and state law can add protections. Ask the reviewer on the phone which expedited timeframe the plan applies and record the answer.

03

What evidence makes an expedited appeal credible?

Current facts, dated by the hour where possible. Reviewers on an urgent appeal want the attending clinician's statement of urgency, the last few days of progress, nursing and medication notes, the current treatment plan, and a concrete step-down plan showing what must happen before a safe discharge and when.

04

How do you send an expedited appeal correctly?

Label it as expedited on the first line, use the fastest channel the notice names, and call the plan to confirm it was logged as urgent. Attach the clinician's statement of urgency, keep the facts current, ask for continued coverage where the rules provide it, and log every call and confirmation number.

  1. 01Write EXPEDITED (URGENT) APPEAL as the first line and in the portal or fax cover sheet.
  2. 02Have the treating physician or clinician sign a short statement naming the specific clinical risk of waiting for a standard decision.
  3. 03Fill in the last 48 to 72 hours of clinical facts with dates and times, and the concrete conditions for a safe step-down.
  4. 04Keep only the continued-coverage paragraph that matches the plan type, and delete the others.
  5. 05Send by the fastest channel the notice names. If a phone request is allowed, make it and follow with the written letter.
  6. 06Call to confirm the plan logged the request as expedited, and record the reference number, the time and the expected decision time.
  7. 07If the plan refuses expedited handling, ask for that decision in writing and keep treating according to clinical judgment while you escalate.
05

What mistakes slow expedited appeals down?

The common mistakes are sending an urgent appeal by mail, omitting the clinician's statement of urgency, attaching admission notes instead of current ones, and failing to confirm that the plan logged it as expedited. Each can turn a 72-hour decision into a standard one that arrives after discharge.

  • Mailing an urgent appeal when the notice allows portal, fax or phone requests.
  • No signed statement of urgency, so the plan treats the request as standard.
  • Attaching only admission documentation when the reviewer needs the last three days.
  • Not asking for continued coverage where the plan type provides it.
  • Skipping the confirmation call and losing a day to a misrouted fax.

Fictional example

A fictional detox-to-residential continued-stay denial

Clearwater Recovery (fictional) admitted a 29-year-old for withdrawal management, followed by residential care. On residential day 6 at 4 p.m., the plan's concurrent reviewer ended coverage as of the next morning, stating the member could step down to PHP.

At 6 p.m. the attending physician signed a statement of urgency citing a seizure history and an unstable housing situation documented by the case manager. The program sent the expedited appeal through the plan's portal with the last 72 hours of nursing notes, called to confirm it was logged as urgent, and recorded the reference number. The letter asked the plan to confirm coverage would continue while the appeal was pending.

Where ClaimParrot fits

What a ClaimParrot packet does here

  • Rather not start from a blank page? An appeal packet drafts the expedited continued-stay appeal from the plan's stated reason and your de-identified summary.
  • Each packet holds an appeal letter draft, an evidence checklist and a deadline plan, checked by a person before delivery: $29, or $99 for level-of-care denials, and the first packet is free (pricing).
  • You copy the payer's reason into the form with a de-identified summary; no notices, remittances or records are sent, and no PHI is accepted (Trust & security).

Every draft is reviewed and approved by your team. ClaimParrot does not make medical-necessity determinations or give legal advice.

Common questions

Frequently asked questions

Who can certify that an appeal is urgent?

Under the ERISA claims rules, if a physician with knowledge of the patient's condition determines a claim is urgent, the plan must treat it as urgent. Plans may also accept statements from other treating clinicians. Have the attending physician sign whenever possible.

Does the patient have to leave when coverage ends?

Coverage decisions and treatment decisions are separate. The treating team decides when discharge is clinically safe. Discuss the financial risk with the patient or family, request continued coverage where the plan type provides it, and document both.

Can we request a peer-to-peer and an expedited appeal at the same time?

Usually yes. A peer-to-peer may resolve the denial in hours, but it does not stop the appeal clock and is not an appeal itself. File the expedited appeal and prepare the call with the peer-to-peer prep sheet.

What if the plan misses the expedited deadline?

Document the time the request was received and the time the decision arrived. Under the ACA rules, a plan that fails to follow the claims and appeals requirements can be treated as having exhausted its internal process, which may open external review sooner. State rules can add remedies.
